A valve manufacturer is suing a former employee, Gerard Fanner, and
Swissfluid USA Inc., citing alleged misappropriation of trade secrets.
Bray International Inc. filed a complaint on Feb. 27, in the Harris County
District Court against the defendants, alleging that they violated the
Texas Civil Practice and Remedies Code.
According to the complaint, the plaintiff assumed defendant Fanner's
employment agreement from one of its competitors, along with other assets.
As a result of defendants' actions, the plaintiff has suffered and will
continue to suffer irreparable harm until the court has rendered a decision
in its favor.
The plaintiff holds Fanner and Swissfluid USA Inc. responsible because on
Feb. 2, Fanner allegedly transferred confidential information to Swiss and
later terminated his employment with the plaintiff. He began working for
Swiss on Feb. 9.
The plaintiff requests a trial by jury and seeks actual and exemplary
damages, interest, costs of this action and any other just relief. It is
represented by D. Scott Funk of Gray, Reed & McGraw LLP in Houston.
