Insurance Technologies Corp. is on track to pay $11 million as part of a
class settlement over a 2021 data breach that affected more than 4.3
million people, according to a grant of preliminary approval by a Texas
federal judge.

Jay Heath, Edward Shapiro, and Daisy Becerra Lopez claim that the insurance
software company, a subsidiary of Zywave Inc., failed to safeguard customer
information. That allowed hackers to access their names, addresses, phone
numbers, driver’s license numbers, Social Security Numbers, dates of birth,
email addresses, genders, usernames, and passwords.

On Monday, Judge David C. Godbey of the U.S. District Court for the
Northern District of Texas granted preliminary approval of the settlement,
which includes $2,000 for each named plaintiff and reimbursement of up to
$5,000 of out-of-pocket expenses per class member—including up to eight
hours of lost time at $25 per hour and 12 months of financial fraud
protection.

The national class is estimated to be at 4,341,523 potential members, all
individuals whose personal information was potentially compromised by the
breach, as confirmed by ITC’s business records.

If Godbey grants final approval of the settlement, additional funds will be
given to the California subclass, comprised of 318,091 individuals, who
will receive between $100 and $300 in relief each.

ITC will pay attorneys up to one-third of the settlement fund in fees, plus
litigation costs and expenses up to $30,000.

Plaintiffs are represented by Kendall Law Group, Mason Lietz & Klinger LLP,
Morgan & Morgan, and Clayeo C. Arnold APLC. ITC is represented by Foley &
Lardner LLP.
